According to Senior Advocate of Nigeria (SAN) Oba Maduabuchi, there is no basis for Siminalayi Fubara, the governor of Rivers State, to be impeached. Maduabuchi made it clear that the Court of Appeal’s ruling did not put the lawmakers who defected back in their seats in an interview with Arise News.
He explained that the Court of Appeal only decided that the person who issued the injunction against the lawmakers lacked the right to do so, not that the legislators’ positions were legitimate. He underlined that lawmakers should file legal challenges against the Speaker’s proclamation that their seats are vacant because it is still a crucial issue.
He states, “It’s reasonable to anticipate that they will begin the impeachment process against Fubara on the grounds that their membership has been revalidated, as the Court of Appeal mistakenly believed.” It’s untrue.
The Court of Appeal only declared that the individual who imposed restrictions or issued injunctions against you lacked authority.
