According to the Daily Trust, constitutional expert Professor Auwalu Yadudu has shed light on the legal options available to the government in the case of Nnamdi Kanu, leader of the Indigenous Peoples of Biafra (IPOB). According to Yadudu, the Attorney General of the Federation has the power to discontinue Kanu’s trial, but this would require a commitment from Southeast leaders and elders.
This development comes as pressure mounts on President Bola Ahmed Tinubu to release Kanu, who was re-arrested in Kenya and renditioned to Nigeria to face charges of terrorism and treasonable felony.
Yadudu’s expertise highlights the complexity of the case, emphasizing that a simple bail application may not be the most effective solution, given Kanu’s history of jumping bail. Instead, he suggests exploring alternative routes that prioritize goodwill and commitment from all stakeholders.
As the debate surrounding Kanu’s release continues, Yadudu’s insights provide a nuanced understanding of the legal possibilities available to the government.
His expertise underscores the need for a balanced approach that addresses the concerns of all parties involved, paving the way for a potential resolution to this high-profile case.
In his own words, “Obviously, the appearance by the attorney general to discontinue further proceedings does not mean that the party, the beneficiary, is discharged, acquitted, and relieved of all responsibilities for what is being alleged against him. The attorney general can resume or bring further fresh actions against them if they do not make good on the undertaking they make. The bail application is not a reconciliatory route for both sides. First of all, Kanu has obtained bail in the past, during the previous regime, and he has jumped that bail, so I don’t think it is the best route for both of them. Nnamdi Kanu was re-arrested in Kenya and renditioned by the government of former President Muhammadu Buhari. He was arraigned in court on charges that bordered on terrorism and a treasonable felony. There have been calls from some interest groups and political leaders from the south-east for the government to release him.………See More
